"They Did What?"

Crush Corona with CBD! An FDA Warning Letter Issued to Living Senior, LLC.

Why companies don’t learn from others regarding advertising for CBD products and making medical-related claims or inferences. On August 19, 2020 the FDA issued a warning letter to Living Senior, LLC regarding Unapproved and Misbranded Products Related to Coronavirus Disease 2019 (COVID-19).

The FDA is constantly monitoring social media and advertising and reports come in regarding companies making health claims that are not grounded in research or at least not referencing to the research they are basing their claims on.

The FDA had done a search and on a website that is owned by Senior Living, www.blueribbonhemp.com, offers CBD products for sale in the United States and that these products are intended to mitigate, prevent, treat, diagnose, or cure COVID-19 in people.

In the warning letter it states, “In addition, it is unlawful under the FTC Act, 15 U.S.C. 41 et seq., to advertise that a product can prevent, treat, or cure human disease unless you possess competent and reliable scientific evidence, including, when appropriate, well-controlled human clinical studies, substantiating that the claims are true at the time they are made.

For COVID-19, no such study is currently known to exist for the products identified above. Thus, any coronavirus-related prevention or treatment claims regarding such products are not supported by competent and reliable scientific evidence. You must immediately cease making all such claims. Violations of the FTC Act may result in legal action seeking a Federal District Court injunction and an order may require that you pay back money to consumers.

Dr. Bob Melamede discusses how NAC and CBD fight viral infections like Coronavirus and Senior Living posted on thier website the following:

“HOW TO DEAL WITH THE CORONAVIRUS [emphasis in original] WITH RICHARD COWAN . . . Why are People Hoarding Toiler Paper as a Result of the CoronaVirus masked face emoji? . . . Now, on the other hand, there really are things that you should be stocking up on . . . CBD. Believe it or not, edible cannabis or edible CBD. The fact is that we know that cannabis has some
antiviral activity, whether or not that will make the slightest difference for the Coronavirus, I have no idea. I’m not telling you to do this because this will cure or prevent that. But, we also know that it is anti-inflammatory. . . But to have an edible, a sublingual, you know, some form of cannabis (whole cannabis or CBD). This is something that you should have in your house, because most people, unless they’re really old like me, are at really very low risk of dying from the virus. But it only on the other hand is like a bad case of the flu; it makes people feel really, really bad. And so for just symptomatic relief, this is something that you should think about.” [from your website www.cbdseniors.com/why-are-people-hoarding-toilet-paper-as-a-result-of-the-coronavirus-%f0%9f%98%b7-covid-19/]”

Clearly their are many benefits to hemp and cannabis related products that consumers have reported, but making claims related to the current pandemic leads to questionable behavior.

Again learn from others. Here is the FDA site where all claims they are investigating related to Coronavirus are documented, https://www.fda.gov/consumers/health-fraud-scams/fraudulent-coronavirus-disease-2019-covid-19-products. #LearnFromOthers #ILoveCompliance #KUWIA #JSNTP
